The International Court of Justice: Will it be Just?

By: Soraya Sepahpour-Ulrich

The media is hyped up about the Israelis wanting to sue Ahmadinejad for the comments he made.  Israeli lawyers claim that his attacks on Israel and his calls for the ‘annihilation’ of the Jews broke a 1948 UN genocide convention to which Iran is a signatory.  Not withstanding the incorrect translation of Zionism vs. Judaism, a speech which would lend itself to the equivalent of regime change, Israel should first examine its own record before attempting to sue in the International Court of  Justice (ICJ).  Or else we must ask what has emboldened this small nation that has defied and sullied the United Nations through its proxy, the United States, to attempt to desecrate the International Court of Justice as well.

Israel has little regard for the United Nations and its subsequences as it passed over 40 resolutions against it in the time span between 1955-1992 [i] alone- this with the powerful United States firmly behind it. It is worthy to note that the number fell sharply after the Cold War – while Iran has had no resolutions passed against her.  More importantly, and closer to the subject of genocide, Israel’s track record is an open book in its treatment of Palestinians.  However, what is not readily publicized, is the intention of the Israeli officials in their desire to annihilate Palestinians.

The following are excerpts from leaders of the Israeli community:

During a sermon preceding the 2001 Passover holiday, the influential Israeli Rabbi Ovadia Yosef exclaimed: "May the Holy Name visit retribution on the Arab heads, and cause their seed to be lost, and annihilate them." He added: "It is forbidden to have pity on them. We must give them missiles with relish, annihilate them. Evil ones, damnable ones." Source: Ha'aretz April 12, 2001

"One million Arabs are not worth a Jewish fingernail."

--Rabbi Yaacov Perrin, Feb. 27, 1994

"We declare openly that the Arabs have no right to settle on even one centimeter of Eretz Israel...Force is all they do or ever will understand. We shall use the ultimate force until the Palestinians come crawling to us on all fours."-Rafael Eitan, chief of staff of the Israel Defense Forces, quoted in Yediot Ahronot, April 13, 1983, and The New York Times, April 14, 1983.

"We must use terror, assassination, intimidation, land confiscation, and the cutting of all social services to rid the Galilee of its Arab population."-Israel Koenig, "The Koenig Memorandum."

"...the need to sustain the character of the state which will henceforth be Jewish...with a non-Jewish minority limited to 15 percent. I had already reached this fundamental position as early as 1940 [and] it is entered in my diary."-Joseph Weitz, head of the Jewish Agency's Colonization Department.

"Everybody has to move, run and grab as many (Palestinian) hilltops as they can to enlarge the (Jewish) settlements because everything we take now will stay ours...Everything we don't grab will go to them."-Ariel Sharon, Israeli Foreign Minister, addressing a meeting of the Tsomet Party, Agence France Presse, Nov. 15, 1998.

While the Israeli lawyers could argue that these quotes are not from the prime minister of Israel- although indeed there is one fine quote from Golda Meir -  one must also consider that Iran’s foreign policy decisions are not made by Ahmadinejad.  These people are equally, if not more influential and their impact on the masses is cause for concern.  Certainly, something the ICJ should take under consideration!

It would be interesting to see how the ICJ would react to a country like Israel, or better said, to America.  Indeed, the US has declined to recognize the authority of the ICJ.  Israel, who does not recognize anyone’s rights but its own, now wants to use a body of justice to punish misquoted words where itself has been left unscathed for heinous acts which have been nothing short of genocide.

"Every time we do something you tell me America will do this and will do that . . . I want to tell you something very clear: Don't worry about American pressure on Israel. We, the Jewish people, control America, and the Americans know it."

-- Israeli Prime Minister, Ariel Sharon, October 3, 2001, to Shimon Peres, as reported on Kol Yisrael radio.

Perhaps it is time for America to wake up.
